Privacy & Cookie Policy

Overview

The following information provides a simple overview of what happens to your personal data when you visit this website. Personal data means any data that can personally identify you. Detailed information on data protection can be found in the Privacy Policy below.

Data Collection on this Website

The data processing on this website is carried out by the website operator. Their contact details can be found in the Legal Notice. Some data are collected when you provide them, for example via a contact form. Other data are collected automatically when you visit the website (e.g. browser, operating system, time of access).

Purpose of Data Use

Part of the data is collected to ensure the error-free provision of the website. Other data may be used to analyse user behaviour.

Your Rights

You have the right to receive information free of charge at any time about the origin, recipient and purpose of your stored personal data. You also have the right to request rectification, blocking or erasure of this data. You can contact us at any time using the address provided in the Legal Notice. You also have the right to lodge a complaint with the competent supervisory authority.

Hosting

This website is hosted by Squarespace (Squarespace Ireland Ltd., Le Pole House, Ship Street Great, Dublin 8, Ireland). Squarespace is a tool for creating and hosting websites. When you visit our website, your data are processed on Squarespace’s servers. This may involve data transfer to the parent company Squarespace Inc., 8 Clarkson St, New York, NY 10014, USA. Squarespace stores cookies necessary for the display and security of the site. Use of Squarespace is based on Art. 6 (1)(f) GDPR (legitimate interest in reliable website presentation). If consent was requested, processing is based on Art. 6 (1)(a) GDPR and § 25 (1) TDDDG, where consent includes cookie storage or device access. Consent can be withdrawn at any time. Data transfer to the USA is based on EU Standard Contractual Clauses and the EU–US Data Privacy Framework.

Email: hello@helenafelixberger.com

The Responsible Party is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data (e.g. names, email addresses or similar information).

Storage Period

Unless a more specific storage period is stated in this Privacy Policy, your personal data will remain with us until the purpose for data processing no longer applies.
If you make a legitimate request for erasure or withdraw your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law). In such cases, the data will be deleted once these reasons no longer apply.

General Information on the Legal Basis for Data Processing on this Website

If you have given your consent to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or, if special categories of data pursuant to Art. 9(1) GDPR are processed, on the basis of Art. 9(2)(a) GDPR. If you have explicitly consented to the transfer of personal data to third countries, processing also takes place on the basis of Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or to access to information on your end device (e.g. via device fingerprinting), data processing is additionally carried out on the basis of § 25(1) TDDDG. Consent may be withdrawn at any time.

Where data are necessary for the performance of a contract or for pre-contractual measures, processing is based on Art. 6(1)(b) GDPR. If processing is required to comply with a legal obligation, we rely on Art. 6(1)(c) GDPR. Processing may also take place on the basis of our legitimate interests pursuant to Art. 6(1)(f) GDPR. Details of the specific legal basis applicable in each case are set out in the relevant sections of this Privacy Policy.

Recipients of Personal Data

In the course of our business activities, we work with various external parties. This may involve the transfer of personal data. We only share personal data with external parties if this is necessary to fulfil a contract, if we are legally obliged to do so (e.g. data transfer to tax authorities), if we have a legitimate interest pursuant to Art. 6(1)(f) GDPR, or if another legal basis permits the transfer. When engaging processors, we only transfer our customers’ personal data on the basis of a valid processing agreement. In cases of joint processing, a joint-controller agreement is concluded.

Withdrawal of Your Consent to Data Processing

Many data processing operations are only possible with your express consent. You may withdraw any previously given consent at any time. A simple email to us is sufficient. The lawfulness of processing carried out before withdrawal remains unaffected.

Right to Object to Processing in Specific Cases and to Direct Marketing (Art. 21 GDPR)

If data processing is carried out on the basis of Art. 6(1)(e) or (f) GDPR, you have the right to object at any time on grounds relating to your particular situation; this also applies to profiling based on these provisions. The respective legal basis for each processing operation can be found in this Privacy Policy.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or where processing serves the establishment, exercise or defence of legal claims (objection under Art. 21(1) GDPR).

Where your personal data are processed for the purpose of direct marketing, you have the right to object at any time to the processing of your personal data for such marketing; this includes profiling to the extent it is related to such direct marketing.
If you object, your personal data will no longer be used for direct marketing purposes (objection under Art. 21(2) GDPR).

Right to Lodge a Complaint with the Competent Supervisory Authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work, or the place of the alleged infringement.
This right exists without prejudice to other administrative or judicial remedies.

Right to Data Portability

You have the right to receive data which we process automatically on the basis of your consent or in performance of a contract, in a structured, commonly used and machine-readable format.
You also have the right to request the transmission of such data to another controller, where technically feasible.

Access, Rectification, Erasure and Restriction of Processing

Within the framework of applicable legal provisions, you have the right at any time to obtain free information about your stored personal data, their origin, recipients and the purpose of data processing, as well as the right to rectification, restriction or erasure of this data.
You can contact us at any time using the address provided in the Legal Notice for this purpose, or for further questions about personal data.

Right to Restrict Processing

You have the right to request restriction of the processing of your personal data. You may contact us at any time using the address provided in the Legal Notice.
The right to restriction applies in the following circumstances:

If you contest the accuracy of your personal data, we need time to verify it. For the duration of verification, you have the right to request restriction of processing.

If processing is unlawful, you may request restriction of use instead of erasure.

If we no longer need your data but you require them for the establishment, exercise or defence of legal claims, you may request restriction instead of erasure.

If you have objected to processing pursuant to Art. 21(1) GDPR, a balance must be struck between your interests and ours. While this is being assessed, you have the right to request restriction of processing.

If processing has been restricted, your personal data – apart from storage – may only be processed with your consent or for the establishment, exercise or defence of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.
